General Terms and Conditions

1. Scope and Business Purpose

General Terms and Conditions for the online sale of simply.C – Christine Platter, with registered office at Via Goethe 24, 39012 Merano, Italy, VAT No. IT 02833730217, registered in the Business Register of the Chamber of Commerce of Bolzano under no. 209571. These General Terms and Conditions apply to all deliveries and services provided by me (hereinafter referred to as “deliveries”) to my customers. They apply exclusively. I do not accept any terms and conditions of the customer that conflict with or deviate from these General Terms and Conditions or from statutory provisions, unless I have expressly agreed to their validity in writing.

2. Ordering and Payment

After selecting the products, you can access your shopping cart by clicking on the shopping cart icon at the top right of the page. There you will see an overview of the products you have selected. By clicking on “Place Order”, you will proceed to the next step of the purchasing process, where you enter your details, such as your name, address, email address and telephone number. In the next step, you will be asked to accept and confirm my General Terms and Conditions and Privacy Policy. The following step takes you to payment. The shop accepts PayPal and credit card payments. By clicking on “Pay Now”, you will be redirected to the PayPal page, where you can enter your credit card details. At the end of the payment process, you will receive a confirmation of your purchase. As the buyer, you undertake to pay the purchase price for the goods ordered within the period and in the manner specified in the contract. You are fully responsible for the accuracy and truthfulness of the information provided in the registration form during the ordering process.

3. Withdrawal

If you are not satisfied with your order, you may return the products within 14 days. The costs of returning the goods must be borne by you. Please contact me at simply.c.handmade@gmail.com. The items must be returned in their original condition and in their original packaging.

4. Delivery and Transfer of Risk

Products are generally dispatched within 72 hours. Products that are in stock may be dispatched sooner. Items that still need to be made may have a slightly longer delivery time. Delivery is carried out by a selected logistics partner. The products are handled with great care in order to avoid any damage. The shipping company is responsible for any damage occurring during transport. In cases of force majeure and other unforeseeable, extraordinary events beyond my control – such as difficulties in procuring materials, operational disruptions of more than a temporary nature, strikes, lockouts, lack of means of transport, official interventions, difficulties in energy supply, etc., including where such circumstances affect upstream suppliers – the delivery period shall be extended by a reasonable period if I am prevented from fulfilling my obligations on time as a result. If delivery becomes impossible or unreasonable due to the circumstances mentioned above, I may withdraw from the contract. You shall have the same right if continuing to perform the contract is unreasonable for you. However, I may only invoke these circumstances if I have been notified of them without undue delay.

5. Retention of Title

The goods shall remain the property of the creditor until the purchase price has been paid in full.

6. Prices and Shipping Costs

The prices stated in the offer at the time the order is placed shall apply. Shipping costs within Italy are €7.00. For orders from Austria or Germany, shipping costs are €15.00. Shipping to other EU countries costs €22.00, with the exception of Switzerland, Norway and Andorra, where shipping costs are €36.00. 7.  Payment Methods

You can pay for your order by credit card (Visa, MasterCard, etc.) or via PayPal. Your personal and payment details will, of course, be treated confidentially.

8. Place of Jurisdiction / Severability Clause

The exclusive place of jurisdiction shall be the Court of Bolzano. All contractual relationships between the contracting parties shall be governed exclusively by Italian law, excluding the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG).
